American Waste Software
Terms of use
Last updated
These terms are the rules for using American Waste Software (“we”, “us”, “the service”): the office screens, the driver app, the customer portal and the online booking pages. “Your hauler” means the roll-off dumpster company that uses American Waste Software: the company you rent from, or the company you work for.
By signing in or using the service, you agree to these terms. If you don’t agree, please don’t use it.
In short
- American Waste Software is a tool your hauler uses. Your rental itself is between you and your hauler.
- Keep your sign-in private, and use the service only for your own work or account.
- Your hauler approves requests, sends the invoices and receives the payments.
- An order on a hauler’s booking page is with that hauler, under the rental agreement you sign there; a card payment goes to the hauler.
- We work to keep the service running, but we can’t promise it’s never down.
1.What the service is
American Waste Software is software for roll-off dumpster companies. Your hauler uses it to book jobs, send out drivers, keep track of dumpsters and send invoices. Customers use the customer portal to see their dumpsters, ask for service and see their invoices. Drivers use the driver app to see their stops and record what they did. Your hauler can also put a booking page on its own website, where anyone can order a dumpster online.
We provide the software. We don’t rent dumpsters, haul anything or set prices. Your rental (prices, what may go in the dumpster, damage, how long you keep it) is between you and your hauler, under your hauler’s own rental agreement.
A hauling company that subscribes to American Waste Software also has its own agreement with us. Where that agreement says something different, it wins for that company.
2.Accounts and sign-ins
- You must be 18 or older to use the service or to book online.
- Your hauler gives you your login, and can change it or turn it off.
- Keep your password private. Don’t share your login or use someone else’s.
- You’re responsible for what’s done with your login. If you think someone else used it, tell your hauler right away.
- After too many wrong passwords, a login locks for a while to keep it safe.
3.Using the service the right way
Please don’t:
- break the law, or use the service to harm, cheat or harass anyone;
- try to see or change records that aren’t yours, or get around a sign-in or a limit;
- probe the service for weak spots, overload it or slow it down;
- copy the service with automated tools, or copy, resell or take apart the software;
- upload viruses or other harmful files, or anything you don’t have the right to share;
- send spam or unwanted messages through it;
- place fake orders on a booking page, sign one in someone else’s name, or use it to try out card numbers.
We may suspend a login that breaks these rules or puts the service or other people at risk.
4.The customer portal and requests
- A request in the portal (a delivery, a pickup, a swap and so on) is a request, not a booking. Your hauler decides whether to accept it, and sets the day and the price.
- Your hauler sets a cutoff time for next-day service. A request sent after it may be done later.
- Please check what you enter: the address, where to put the dumpster, and who to call.
- Your hauler may change or decline a request, and will let you know.
- The portal shows your account as your hauler recorded it. If something looks wrong, contact your hauler.
5.Booking online
Your hauler can put a “Book a dumpster” page on its own website. You don’t need a login to order there. When you place an order on it:
- Your order is with that hauling company, under its own rental agreement, which the booking page shows before you book. You sign it on the page: you type your full name, draw your signature and tick “I have read and agree to the rental agreement”.
- Right above the button that places the order, the page shows the hauling company’s payment terms with your order’s prices filled in. You accept them when you tick “I agree to these payment terms”.
- By signing, you agree to sign electronically: your typed name, your drawn signature and your ticks are your signature on the rental agreement and the payment terms, and your hauler may rely on that signed record. You can download a copy of what you signed after you book.
- The rental agreement and the payment terms are the hauling company’s own. We don’t review them, and nothing in them or on the booking page is legal advice from us.
- The prices, sizes, days and discount codes on the page are the hauling company’s. Charges the page says are billed after pickup, such as extra days or weight over what’s included, come on your hauler’s invoice.
- A card payment goes to the hauling company’s own Stripe account, not to us. The card is kept on file with Stripe for your hauler, which can charge it for later invoices, such as extra days or weight, as its payment terms say.
- Cancelling and refunds follow the cancel rule shown on the booking page when you order. Your hauler makes refunds, back to the card you paid with.
- American Waste Software only passes your order on to your hauler. Questions about an order, a charge or a refund go to your hauler.
For hauling companies: your rental agreement and payment terms are your own words, even when your payment terms start from our sample wording, and you keep them current in Online Booking → Settings. Each order keeps the exact words its customer signed, so a later change applies only to new orders. We don’t review your words and they aren’t legal advice, so have your attorney read them.
6.Invoices and payments
- Invoices come from your hauler, and payments are owed to your hauler, not to us.
- Your hauler sets the prices, fees, taxes and payment terms.
- Questions or disagreements about a charge go to your hauler.
- When your hauler takes cards, a card payment company handles them for your hauler. We never store card numbers.
7.Photos and records
- Photos, weight tickets, notes and other records added to the service belong to your hauler, or to whoever owns them.
- When you add something, you confirm you’re allowed to, and you let us keep it and show it to the people who need it for the job and the bill, for example a weight ticket’s picture with an invoice.
- Your hauler may use these records as its record of the job, for example to show when and where a dumpster was dropped off.
- How we handle information is explained in our privacy policy.
8.Text messages
When your hauler turns texting on, texts go only to numbers that agreed to get them, and agreeing isn’t a condition of buying anything. Message frequency varies. Msg & data rates may apply. Reply STOP to stop and HELP for help. Carriers aren’t liable for delayed or undelivered messages. The details are in the Text messages part of the privacy policy.
9.When the service is available
- We work to keep the service running and your records safe, but we can’t promise it will always be available, fast or free of mistakes.
- Updates may interrupt it for a few minutes.
- We may change, add or remove features.
- Keep your own copies of anything important, like invoices and receipts.
10.Changes to these terms
We may update these terms. The date at the top shows when they last changed. If a change is important, we’ll tell your hauler before it takes effect. Using the service after a change means you accept the new terms.
11.Ending use
You can stop using the service any time. Your hauler can turn off your login, and we may suspend or end access that breaks these terms. Ending use doesn’t cancel anything you already owe your hauler. The parts of these terms that should last, like the limits below, still apply afterwards.
12.Limits on our responsibility
We provide the service “as is” and “as available”. As far as the law allows:
- we don’t promise the service will meet every need or work without interruptions or mistakes;
- we aren’t responsible for indirect losses, such as lost profits, lost business or lost data, or for what your hauler does or doesn’t do;
- our total responsibility for any claim about the service is limited to the greater of $100 or what you paid us for the service in the 12 months before the claim.
Some places don’t allow some of these limits, so they may not all apply to you. Nothing here limits responsibility that the law doesn’t allow to be limited.
13.Questions
Questions about these terms? Contact your hauler: the company you rent the dumpster from, or the company you work for. They can answer most questions and will reach us when needed.
